Reporting infringement
Your notice must be in writing and include:
- Your physical or electronic signature, as the copyright owner or someone authorized to act for the owner.
- The copyrighted work you say is infringed. If one notice covers several works, a list of them.
- The material you say is infringing, with the page URL or other details that let us find it.
- Your name, address, phone number and email address.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.
Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f).
When we receive a complete notice, we promptly remove or disable access to the material and tell the person who posted it. This applies to material posted by users and band managers, and to material we added ourselves.
Counter-notice
If your material was removed and you believe that was a mistake, send our designated agent a written counter-notice that includes:
- Your physical or electronic signature.
- The material that was removed and where it appeared before it was removed.
- A statement under penalty of perjury that you believe in good faith the material was removed or disabled by mistake or misidentification.
- Your name, address and phone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district in which we may be found, and that you will accept service of process from the person who sent the original notice or that person's agent.
We send the counter-notice, including your contact details, to the person who sent the original notice. Unless that person tells us they have filed a court action, we restore the material 10 to 14 business days after we receive your counter-notice.
Repeat infringers
In appropriate circumstances, we end the accounts of users who repeatedly infringe copyright, and we remove band managers from band pages for the same reason. We keep a record of the valid notices we receive against each account.
Trademarks and other concerns
This process is for copyright. For a trademark or other rights concern, email support@thebandindex.com with the details. See also our Independence and Trademark Notice and Terms of Use.
