Band Content License

Version 2026-10-15

This licence is between the person who accepts it (for themselves and for the band), and The Band Index ("we", "us"). It applies when you accept it in the band portal. It adds to our Terms of Use. It does not replace them.

1. Who accepts this

You accept this licence when you claim a band, submit a new band, or manage a band page as an owner or editor in the band portal. You accept it for yourself and on behalf of the band. By accepting, you confirm that you are authorised to act for the band.

2. What this licence covers

"Band Content" means:

  • content you provide through the band portal, such as logos, photos, bio text, links, page layout and official posts; and
  • content already on the band's Band Index page, such as its logo, photos, bio and links.

This licence covers Band Content only to the extent that the band, or you on its behalf, owns or controls the rights in it.

3. What you give us

You give The Band Index a worldwide, non-exclusive, royalty-free licence to use the Band Content in these ways:

  • Display and distribute. Host, store, reproduce, display and distribute the Band Content on The Band Index website, the iOS app, and any future Band Index apps or surfaces.
  • Translate and adapt. Translate the Band Content into the languages our site supports, including by machine or AI translation. Adapt it by resizing, cropping, reformatting or excerpting it, and use it in cards, search results, embeds and generated share images.
  • Promote. Use the Band Content in The Band Index's own social media posts, newsletters and promotions, to promote the band, The Band Index, or both.

4. Who may handle it for us

We may pass these rights on only to service providers acting for The Band Index, such as hosting, content delivery, translation and analytics providers. They may use the Band Content only to provide their services to us.

5. What this licence does not cover

  • Third-party rights. This licence does not grant any rights that you or the band do not own or control. For example, if a photographer owns the copyright in a photo, this licence does not give us rights in that photo. You must get those rights before you submit the photo.
  • Credits. Existing photo credits, artist and photographer credits, and other attributions stay in place. We will not remove them where they are shown.
  • Ownership. The band keeps ownership of its Band Content. This licence does not transfer ownership to us.

6. No obligation to use

We have no obligation to use, display, promote or translate any Band Content. We decide how and where it appears on our platforms, subject to our Terms of Use.

7. No payment

This licence is free. You do not pay us for it, and we do not pay you for it.

8. Removing content or ending the licence

You can ask us to:

  • remove specific Band Content; or
  • end this licence for future use.

Send your request by email to [email protected]. We will stop new uses of the content within 30 days of your request.

Content that has already been published may remain in these places, and we cannot always remove it:

  • social media posts and newsletters that have already been sent or published;
  • caches, search indexes and content delivery copies, which clear on their own schedule; and
  • backups and archives.

We will not create new uses of the removed content from these places.

9. Changes to this licence

We may change this licence. A change comes as a new version with a new date. Band managers must accept the new version in the band portal. Until they do, the version they last accepted continues to apply.

10. Relationship to the Terms of Use

This licence adds to our Terms of Use. If the two conflict about Band Content, this licence applies to that Band Content. The governing law in the Terms of Use, the laws of the State of Washington, United States, also applies to this licence.
